Judge lets kidnapping charges stand

ImagePITTSFIELD — A Central Berkshire District Court judge has denied an attempt to dismiss charges filed against a Dalton man accused of kidnapping his three children in January after failing to surrender them to the Department of Social Services.

The court yesterday scheduled Louis A. Piccone's trial for Oct. 27 in District Court's jury-of-six session. Several other legal issues pertaining to Piccone's trial were also discussed yesterday, including two additional defense motions, one of which has yet to be filed, and the defendant's current bail status.

Piccone, 45, of Kirchner Road, has been charged with three counts of kidnapping of a minor by a relative, charges that the commonwealth has filed as misdemeanors. Those charges carry a maximum penalty of three years in jail and $3,000 in fines.

Piccone, a patent attorney, is currently free on $50,000 bail posted by his sister, an attorney with the federal Department of Homeland Security.

Columbo murder trial delayed again

ImageA judge this week granted a request from Patrick Powell's lawyers, further delaying the trial for the teen accused of killing Daniel Columbo two years ago in Milford.

"The reality is we have an expert witness who's ill," said John Swomley, a Boston lawyer who represents Powell.

Worcester Superior Court Judge Robert J. Cosgrove on Monday overruled Assistant District Attorney Eduardo Velazquez's objection to moving the date from Oct. 6 to Dec. 1 to accommodate the defense team.

"I think (Velazquez) wanted the trial to move forward," said Tim Connolly, spokesman for Worcester County District Attorney Joseph Early's office.

Powell, who turned 19 on Monday, is accused of stabbing 21-year-old Columbo to death on Carroll Street in Milford on Jan. 6, 2006.

Another Massachusetts Outrage - Police Descend on Bernard Baran's Mother

Dear Friend of Justice,

The Pittsfield police gave Bee's mother a nice Mother's Day present -- they descended en masse, lights flashing, on her home this morning.

They pounded on her door, demanding Bee, claiming that they had a warrant for his arrest.

When they conceded to Bee's brother that they in fact had no warrant, they were denied admission.

Judge Locke had issued Bee a court order giving him permission to visit his mother from yesterday through Monday morning.

No one bothered to tell the people who do the GPS monitoring or the Pittsfield Police.

One of the most amazing things about Massachusetts government is its gross incompetence -- gross incompetence that extends all the way to the top.

Dalton man denies child kidnapping

ImagePITTSFIELD — A Dalton man cannot be charged with kidnapping his own children, his attorney argued yesterday, because the children were not in the state's jurisdiction when a Juvenile Court put them in state custody.

Louis A. Piccone, 45, is facing kidnapping charges in what the state claims is a case of international flight, in which the parents spirited the children to Russia — where their mother is a citizen — via Canada and Paris.

Piccone and his wife, Elena, were under investigation by the state Department of Social Services for alleged abuse of one of their three children. On Jan. 18, the DSS persuaded a Juvenile Court judge to grant the agency temporary custody of the children while the investigation was carried out.

But John G. Swomley, a Boston attorney representing Piccone, argued during a hearing in Central Berkshire District Court yesterday that the Juvenile Court had no authority over the children because they left the state on Jan. 15 — three days before the hearing — and were staying in New York. Swomley said the children never returned to Massachusetts after that date.
