INVOLUNTARY COMMITMENT/SEX OFFENDER REGISTRATION

Individuals petitioned against under present civil commitment laws may face lifetime incarceration.  These proceedings are highly complex in nature and successful representation requires a thorough understanding of the science and expert testimony involved.

For over 13 years, Swomley & Associates has dedicated a large portion of its practice to effectively representing individuals who are facing, or seeking release from, civil commitment. This includes preparing and advising the client on treatment related issues and interviews with government experts, retaining and consulting with our own independent experts, and rigorously challenging the underlying scientific and legal underpinnings of these cases.

These cases often involve difficult facts and a high range of emotion. Moreover, the public outrage against sex offenders creates a unique obstacle to victory not present in routine criminal cases. Our continued success in the face of these challenges shows the depth of our experience and knowledge in appropriately handling these matters.

We also have extensive experience representing clients before the Sex Offender Registration Board. We have successfully helped clients lower their level before the Board, thus assuring their ability to maintain privacy and be able to move on with their lives.

We have recently been called on to train lawyers in New York, New Hampshire, North Carolina, and now at the Federal level with the passage of new civil commitment laws. Our lawyers are frequent panelist in Continuing Legal Education seminars.
